Share to Twitter Share to Linkedin The federal government can’t use “circumstantial evidence” to permanently confiscate nearly $70,000 in cash, a federal appeals court ruled on Wednesday. “While it may be dubious to drive around with a large amount of cash in one’s car,” Judge Julius Richardson wrote for the Fourth Circuit U.S. Court of Appeals, “it does not create an inescapable inference of criminal activity. Not using a bank does not necessarily make one a criminal.” After Dereck McClellan passed out in his car at a South Carolina gas station in January 2019, police searched the vehicle. Inside they found a blunt in the ashtray, an empty liquor bottle riding shotgun, and a duffle bag stuffed with cash in the trunk. Their search also revealed a bundle of cash in the console. All told, Dereck was carrying $69,940.50 in cash. That money, Dereck said, came from a retail business he was running with his girlfriend. Although Dereck was arrested for public … [Read more...] about Federal Court Upholds The Right To Carry Cash

Democratic Degradation Is Law’s Ultimate Disruptor
Share to Twitter Share to Linkedin The legal industry has been remarkably buoyant in a tumultuous world. It has weathered 9/11, the global financial crisis, economic downturns , automation, digital transformation , domestic and international instability, and the Pandemic. Through it all, the legal sector has prospered financially , even as its resistance to change has misaligned it with business and distanced it from society . Law’s financial success has come at a steep price—the health and well-being of its workforce, an obscured purpose, and high profits but low customer satisfaction. Public trust in lawyers , legal institutions , and the vitality of the rule have law are historically low. Most Americans believe the legal system is accessible only to the wealthy and the data confirms this. Arrogance on display (KOR)
The National Assembly’s regular audit of the Blue House was botched after the Blue House refused to send seven presidential aides to the session Thursday. The presidential office cited several reasons, including the need to quarantine an official after a trip overseas. However, its abrupt refusal constitutes a brazen disrespect for the legislature. The almighty Blue House of President Moon Jae-in’s administration has left another bad precedent in the National Assembly’s history. We wonder if the Blue House really regards the legislature as being an equal to the presidency. The seven presidential aides who refused to appear at the audit session included Suh Hoon, director of the National Security Office; Kim Jong-ho, senior presidential secretary for civil affairs; and Ryoo Yeon-sang, presidential security service chief. First of all, Suh should have explained the government’s timid reaction to the brutal murder last month of a South Korean fisheries official by the North Korean … [Read more...] about Arrogance on display (KOR)
Dems’ Reconciliation Package Obscures Obamacare’s Failures With Taxpayer Cash
Share to Twitter Share to Linkedin With fewer than 100 days until the midterms and President Biden's approval rating underwater, Democrats are desperate for a political win they can trumpet on the campaign trail. They're hoping the deceptively named Inflation Reduction Act is it. At the center of the bill is $64 billion in subsidies for health insurance purchased through Obamacare's exchanges. They're an extension of the subsidies created as part of the 2021 American Rescue Plan Act. They were supposed to expire at the end of this year—temporary measures to help households weather the economic impact of the pandemic. But if that happened, people would've received notices of massive premium hikes just before they headed to the polls. Hence, the Inflation Reduction Act's move to extend them for three more years, through 2025. It's a transparent ploy for votes. And it obscures just how much the Affordable Care Act has failed to live up to its name. … [Read more...] about Dems’ Reconciliation Package Obscures Obamacare’s Failures With Taxpayer Cash
China warns US against sailing warships through Taiwan strait
Qin Gang - A + A WASHINGTON/HONG KONG (Aug 17): China called on the US to refrain from sailing naval vessels through the Taiwan Strait, saying Beijing would take further action in the wake of House Speaker Nancy Pelosi’s visit to Taipei. China’s ambassador to Washington, Qin Gang, said on Tuesday that China viewed such Taiwan transits as an escalation by the US and an effort to support the “separatist” government in Taipei. He delivered the warning after Senator Edward Markey, a Massachusetts Democrat, wrapped up the second trip to the island in less than two weeks by a US congressional delegation. “The US side has done too much and going too far in this region,” Qin said in response to a question about potential naval patrols. “I do call on our American colleagues to refrain, to exercise restraint, not to do anything to escalate the tension. So if there’s any moves damaging China’s territorial integrity and sovereignty, so China will respond. China will … [Read more...] about China warns US against sailing warships through Taiwan strait
Fertilizer usage is being pummeled by Europe’s energy crisis
- A + A LONDON/NEW YORK (Aug 17): The energy crunch throttling Europe’s fertilizer output is threatening to force the world’s farmers to use even less of the nutrients crucial for growing food. Soaring prices of gas, a key feedstock, have already curtailed a quarter of Europe’s nitrogen fertilizer capacity, CRU Group estimates. Now, worries are mounting that the crisis will worsen. For Europe, that could mean even less production and more dependence on imports of ammonia, from which nitrogen products are made. That will also have a knock-on impact elsewhere. Faced with higher prices and tighter supplies, farmers may cut global fertilizer usage as much as 7% next season, the most since 2008, the International Fertilizer Association warns. That risk curbing harvests as the world grapples with a cost-of-living crisis and worsening hunger. “If European farmers import more products from other exporters, then for the more fragile agricultural markets in sub-Saharan … [Read more...] about Fertilizer usage is being pummeled by Europe’s energy crisis
These next-gen telescopes will make the James Webb look like a toy
The James Webb Space Telescope (JWST) started its science mission just a few weeks ago, surpassing all expectations while astonishing scientists and the public alike. Its infrared instruments and a light-collecting area 6.25 times larger than the Hubble Space Telescope are delivering sharper photos that go further into the Universe’s past than ever before. advertisement advertisement And yet, it will soon feel like a toy camera. The Webb is just the beginning of a new golden age of astronomy that is bringing us devices that will capture images that we can’t even imagine right now—the aggregate of which will change our perception of existence itself. Two of these future machines are very different from the JWST, each representing two completely different design philosophies. One is the Giant Magellan Telescope (GMT), a titanic device equipped with seven 27.5-foot mirrors that will be housed inside a 12-story building on top of Las Campanas Observatory … [Read more...] about These next-gen telescopes will make the James Webb look like a toy

Korea’s diplomacy tested (KOR)
The U.S. government’s decision to diplomatically boycott the Beijing Olympics was anticipated long ago. As expected, Joe Biden’s administration chose a diplomatic boycott instead of an all-out boycott to avoid criticism of political exploitation of the Olympiad. What’s left for the U.S. administration is rallying support from allies. The issue will certainly be dealt with in The Summit of Democracy on Thursday and Friday and the G7 Foreign Ministers’ Meeting in London next week. Korea is at a crossroads. The government need not hurry to make a decision, yet cannot avoid making one at some point. As wise and practical diplomacy is needed, it must read the zeitgeist of the times carefully. First of all, the government cannot ignore the human rights issue in China. The UK, Canada and Australia are joining the U.S. crusade for that reason. The European Union already adopted a resolution to boycott the Games. The Moon Jae-in administration must first consider South Korea’s enhanced … [Read more...] about Korea’s diplomacy tested (KOR)
