Share to Twitter Share to Linkedin Left to its own devices, water doesn’t remain still for long. The same could be said for regulations to define the federal government’s scope to control the discharge of pollutants and manmade sediment into bodies of water. Last time I wrote about “Waters of the United States” was an overview of WOTUS’ evolving definition and major actions shaping it from the U.S. Environmental Protection Agency, U.S. Army Corps of Engineers and the U.S. Supreme Court (SCOTUS). Keep that tab open – some of it might come in handy as you read on. It’s not difficult to grasp the basics of Congress’ intent in passing the 1972 Clean Water Act (CWA) or how tricky it’s been since for the EPA and courts to wrestle with what, precisely, constitute governable “waters” for this purpose. Trying to keep up with the specific points of contention and how they’ve been addressed over the years, though, is something that challenges even legal experts. … [Read more...] about Agricultural Groups Among Plaintiffs Suing EPA For Revised Water Rule

Relooking At Why You Should Never Make Or Take Job Counter Offers
Share to Twitter Share to Linkedin In my earlier article on this subject, I argued that job counter offers are lame attempts to correct past omissions and are almost never successful. Either people don’t take them or they do take them and end up leaving relatively quickly thereafter. Along the way, they throw the rest of the organization off balance. Of course, they work every-so-once-in-a-while. Those points are still valid, with some pandemic-inspired modifications below. Push And Pull There’s always a push and a pull when someone quits. People do not get offered jobs out of the blue. They may get contacted out of the blue. They may have a chance encounter with someone that leads to a conversation. But there’s always a conversation. And for that to happen, both sides have to be open … [Read more...] about Relooking At Why You Should Never Make Or Take Job Counter Offers
Carlsbad – A Great Destination For Golf And Much More
Share to Twitter Share to Linkedin I went to Carlsbad for golf. I came back wowed by the town and its many other attractions. Carlsbad sits between San Diego and Los Angeles in the great weather epicenter of coastal Southern California. In the golf industry it’s known as the Silicon Valley of the sport, because so many of the big golf club manufactures are based here. For the traveling golf public it is home to two acclaimed destination resorts, the luxury Park Hyatt Aviara and the historic Omni La Costa Resort & Spa, host to many high-profile PGA tour events and other championships. There is also other great golf in the area. But not having kids, I had no idea that Carlsbad was home to Legoland , perhaps its biggest attraction, and one of the first things I saw as I headed to the tee. I didn’t know it had a frozen in time beach town with great atmosphere. I did not know the area is acclaimed for its hiking trails and miles of stunning beaches. … [Read more...] about Carlsbad – A Great Destination For Golf And Much More
